Buried Accounts, Unfinished Justice: Inside the New UBS Nazi-Era Investigation

This report expands upon the October 2025 Ami Magazine investigation by Riva Pomerantz, which uncovered a new cache of documents, legal filings, and intelligence findings linking UBS to undisclosed Nazi-era assets — decades after the world believed the matter resolved.

When U.S. District Judge Edward Kormann approved the 1998 Holocaust-era Swiss Banks Settlement, it was heralded as a final reckoning. The agreement closed more than 30,000 claims, awarded $1.25 billion in restitution, and consigned the records to federal custody. Those sealed archives — now stored in the Jewish Museum of Washington — were meant to put the matter to rest.

But new evidence suggests the 1998 deal may have ended the debate, not the deception.

The Case That Wouldn’t Stay Closed

Fresh documents and witness statements from Israeli and U.S. sources indicate that UBS, as successor to the Basler Handelsbank, may have concealed unreported wartime accounts — deposits linked to Nazi officials and industrialists that never appeared in the 1998 settlement.

At the center of this revived case stands Dr. Gerhard Podovsovnik, Vice President of AEA Justinian Lawyers, one of the world’s largest transnational legal networks. Acting on behalf of Rabbi Ephraim Meir, heir to six principal and twelve subsidiary “Führer Accounts” allegedly opened by Nazi functionaries, Podovsovnik is seeking to force UBS to reopen its archives under U.S. court order.

He has filed motions invoking Fraud on the Court, one of the most serious violations recognized in American procedural law. If proven, it could void the original settlement entirely.

“When You Lie to a Court, You Lie to the Nation”

“Fraud on the Court is not a formality — it’s a fundamental breach,” Podovsovnik says. “If a defendant deceives a federal court, the entire process collapses. Every hidden ledger, every coded account, every transfer must be opened. This is no longer about secrecy — it’s about integrity.”

Legal experts say UBS could soon face an Order to Show Cause, requiring it to justify why sanctions should not be imposed, and a Discovery Order, compelling the release of internal records from 1933–1945, as well as postwar trust transfers and offshore financial structures.

Failure to comply could trigger a global asset freeze, as well as a constructive trust over suspect assets pending investigation.

Lauder’s Warning: “Billions Left on the Table”

Ronald Lauder, president of the World Jewish Congress and one of the original architects of the 1998 Swiss Banks Settlement, has issued a renewed call for transparency. He believes between $5 billion and $10 billion in dormant Nazi-linked assets were never accounted for.

“The banks didn’t open every file,” Lauder said. “If there are assets still hidden, then the moral and legal work of restitution remains unfinished.”

Lauder’s warnings have caught the attention of the U.S. Senate Banking Committee, which continues to investigate unreported wartime deposits, including those once held by Credit Suisse, now absorbed by UBS.

    The Basler Handelsbank Legacy

The Basler Handelsbank, founded in the late 19th century and later folded into UBS, acted as a conduit for Reich-linked gold and foreign currency transactions from 1933 through the end of the war.

According to the new claims, the accounts in question were never transferred to the postwar Claims Resolution process and remain unclaimed in the UBS archive. “UBS inherited not only the Basler Handelsbank’s assets but its obligations,” says Podovsovnik. “Justice doesn’t vanish through merger — it follows the money.”

Mossad Intelligence and the Hidden Ledgers

As Ami Magazine first reported, intelligence provided through Mossad channels helped trace the postwar path of Nazi assets. The information allegedly includes transaction logs and interbank memoranda linking UBS to Delaware-based shell corporations, U.S. private equity funds, and European holding structures established after 1945.

“These are not hypotheticals,” Podovsovnik told The Washington Mirror. “We have chains of transfer — Nazi gold converted into postwar securities, still under UBS control. The funds are within American jurisdiction, and that gives the courts real power.”

A legal source close to the investigation confirmed that the material has been cross-referenced with archived ledgers and declassified intelligence reports from the early 1950s, forming the basis of the forthcoming federal filing.

    Suppressed Records and Tribunal Controversy

The Claims Resolution Tribunal (CRT II) — the body established after the 1998 settlement — is again under scrutiny.

According to Meir’s team, certain claim files were destroyed or withheld, and internal communications implicate compliance officers who allegedly directed the removal of sensitive records. “If proven,” says Podovsovnik, “this is obstruction of justice at the highest level. Fraud on the Court voids everything that followed.”

Judge Kormann’s original order sealed much of the tribunal’s documentation until 2070, but the new evidence could compel early disclosure.

Fraud on the Court — The Legal Earthquake

Under U.S. federal law, Fraud on the Court arises when a litigant deceives the judiciary through suppression or falsification of evidence. The doctrine overrides statutes of limitation: once proven, the court must reopen the case.

“Justice doesn’t expire,” says Podovsovnik. “If the court was misled, the settlement falls apart — immediately.”

He adds that the actions alleged could also violate the Racketeer Influenced and Corrupt Organizations Act (RICO), which authorizes triple damages for systemic fraud committed through an organized enterprise.

UBS’s Response and the Moral Reckoning

UBS says it continues to cooperate with U.S. Senate inquiries into legacy Credit Suisse accounts. Yet historians and restitution advocates argue that the bank’s own archives — particularly those inherited from the Basler Handelsbank — remain closed.

“UBS embodies Switzerland’s financial memory,” says historian Matthieu Leimgruber of the University of Zurich. “Until those records are opened, the debate will never end.”

For Lauder, the issue is moral as much as financial. “This was never only about money,” he told The Washington Mirror. “It’s about truth and accountability. Those who profited from an era of persecution must finally face history.”

    The Long Shadow of Paradeplatz

Inside Zurich’s Paradeplatz — the symbolic heart of Swiss banking — UBS remains a global titan. But the allegations threaten to expose not just hidden accounts, but an inherited culture of secrecy.

“The current UBS leadership is not accused of the original wrongdoing,” Podovsovnik emphasizes. “But once they know and fail to disclose, they become accessories after the fact. Silence is complicity.”

AEA Justinian Lawyers is expected to serve formal notice to UBS Group AG in Zurich and UBS Americas in New York, demanding immediate document disclosure.

“This is UBS’s moment of choice,” says Podovsovnik. “Either they open the archives, or the courts will do it for them.”

    Echoes of 1945 — and 2025

The sealed archives at the Jewish Museum may soon return to the courtroom spotlight. For years, the world assumed all Holocaust-era accounts were identified and compensated. The new intelligence suggests the opposite: that the largest, most politically sensitive deposits — the “Führer Accounts” — were deliberately excluded.

“We are not reopening history,” Podovsovnik says. “We are concluding it — properly, transparently, and lawfully.”

    What Happens Next

The U.S. Senate Banking Committee is expected to issue its findings on Nazi-era financial assets before the end of the year. If investigators verify the new evidence, experts believe the courts could authorize:

    • Reopening of the 1998 Swiss Banks Settlement,
    • RICO proceedings against parties found complicit in concealment, and
    • A global forensic accounting of all UBS and Basler Handelsbank wartime holdings.

Whatever the final judgment, one message resonates from Washington to Zurich:

The past is not over. It was only sealed — and history’s vault is starting to open again.
